The Sweepstakes and Instant Win Game (Promotion) are both sponsored by AFCO, Inc., (Memphis Car Audio)
Eligibility: The Promotion is open and offered only to legal residents of the 48 Continental United States and Washington D.C., who are 18 years of age and older as of March 1, 2011 including over 100 million mobile phone and Internet users within these states. Employees, officers and representatives of The Fulmer Companies (the "Sponsor”), and any of their respective parent companies, affiliates, distributors, suppliers, subsidiaries, retailers, advertising / promotion agencies, and American Sweepstakes & Promotion Co. Inc. (“ASC”) (collectively, “Released Parties”) and members of the immediate family (mother, father, sons, daughters and spouse, regardless of where they reside) and household members of each such employee, whether or not related, are not eligible to participate. Promotion Period: The “Fast Five Movie Premiere” Sweepstakes ("Sweepstakes”) will begin at 12:00 a.m. Eastern Time ("ET") on March 1, 2011 and ends at 11:59:59 p.m. ET on March 15, 2011 ("Sweepstakes Period"). The “Fast Five Movie Premiere” Instant Win Game (“Game Period”) will begin at 12:00 a.m. Eastern Time ("ET") on March 16, 2011 and end at 11:59:59 p.m. ET on May 31, 2011 ("Game Period").
How to Enter: There are three (3) methods of entry for this Promotion (collectively "Promotion Entries"). 1) To enter the Promotion online, participants can access a mobile website located at http://app.signalhq.com/form/sweepstakes/memphiscaraudio ("Website") and follow the online instructions to complete and thereafter submit the entry form ("Online Entry"). 2) To enter the Promotion on the Sponsor’s Facebook page, participants can visit www.facebook.com/memphiscaraudio during both the Sweepstakes Period and the Game Period and click on the Sweepstakes link located on the page (“Facebook Entry”). If participant has not “Liked” the page they are encouraged to click on the “Like” icon before they access the Promotion. Once they have access they must complete all the requested information on the entry form and submit it. 3) To enter the Promotion by text message entry, participants must have a text message capable phone and text the keyword “FastFive” to the shortcode 50101 on their phone and enter their email address when prompted. Standard text messaging rates, terms, and conditions apply and may not be available from all service providers or for all handsets. Check with your service provider for details. Participants will receive only (1) entry into the Sweepstakes per person per mobile number/email address/Facebook account when they enter during the Sweepstakes Period regardless of their method of entry. They will then receive one (1) Entry per person per mobile number/email address/Facebook account per day when they enter during the Game Period. Multiple entries submitted by the same person in excess of the above limit will be disqualified. All Promotion Entries must be received.
All entries become the property of the Sponsor and will not be acknowledged or returned. Sponsor reserves the right, in its sole discretion, to void any and all entries of an entrant that submits more than the stated maximum limit of entries by using multiple/different e-mail addresses, identities, registrations and logins, or any other methods, or who Sponsor believes has attempted to tamper with, influence or impair the administration, security, fairness, or proper play of this Sweepstakes. Sponsor is not responsible for lost, late, incorrect, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Use of any automated system to submit entries is prohibited and will result in disqualification of all such entries as well as the entrant.
Sweepstakes Prize: The Sweepstakes will have One (1) Grand Prize. The Grand Prize Winner will receive a four (4) day / three (3) night trip for two (2) individuals to Rio de Janeiro, Brazil (“City”) (“Trip”) to see the world premiere of the theatrical film Fast Five (“Event”) taking place on April 15, 2011. The Grand Prize consists of the following elements: one (1) hotel accommodations for two (2) persons one (1) standard room/double occupancy at a four-star hotel; round-trip coach air transportation for two (2) persons between the major metropolitan airport nearest winner’s residence (“airport of origin”) and to airport in or near Rio de Janeiro; two (2) tickets to attend the world premiere showing of Fast Five on April 15, 2011(“Event”). Airline carrier and hotel regulations and conditions apply. Stopovers are not permitted. If a stopover occurs, the Grand Prize will terminate at the stopover point and full fare will be charged for the remaining segments of the flight. Sponsor (or Sponsor’s designee), in its sole discretion, will determine transportation and lodging accommodations. Travel, Event tickets and accommodations are subject to capacity controls, availability, blackout dates and other restrictions, all of which are subject to change at Sponsor’s sole discretion. Winner and his/her guest will be solely responsible for all other expenses not specifically set forth herein including but not limited to round trip transportation between the winner’s residence and any airport of origin, taxes, gratuities, parking fees, laundry service, food, alcoholic beverages, merchandise, souvenirs, telephone, in-room services, tips and any other incidentals. If the Event portion of the Grand Prize is cancelled or rescheduled for any reason, Sponsor will not be responsible for awarding that portion of the Grand Prize, but the remainder of the Grand Prize package will be awarded. The Approximate Retail Value (“ARV”) of the Grand Prize is $3,000 which will vary depending upon point of departure. Total ARV of Sweepstakes Prize pool is $3,000. Sweepstakes winner may accept a cash option of $2,100 (70% of Grand Prize ARV), in place of the Grand Prize.
Instant Win Game Prizes: The Game has a total of 1,136 prizes which include the following: One (1) Authentic Fast Five Memphis Car Audio System which includes two (2) pair of 6 x 9 coax speakers, 2 12’ subwoofer, one (1) five channel 1,000 watt hybrid amp, one (1) Farad digital monitor capacitor, one (1) 4 gauge wiring kit and installation (ARV $2,500); Ten (10) VIP Passes to Universal Studios Hollywood theme park which includes behind-the-scenes experiences and access to closed-to-the-public sets and working soundstages led by an experienced personal guide, the VIP Lounge, gourmet lunch in the VIP Dining Room and valet parking (ARV $250.00); Twenty-Five (25) AFM1 Fulmer Motorcycle helmets, the same model as used in the Fast Five movie (ARV $145.00); One Hundred (100) Fast Five DVD’s (ARV $20.00); and One Thousand (1,000) Fast Five movie ticket packages that include two tickets to a local theater per package (ARV $16). Total ARV of all Game prizes: $26,625.
Drawing and Notification: Sweepstakes Grand Prize Winner will be selected in a random drawing from among all eligible entries received, to be conducted on or about March 16, 2011, by Sponsor, or authorized representative of Sponsor, whose decisions are final on all matters relating to this Sweepstakes. Odds of winning will depend on the total number of eligible entries received.Winner will be notified by e-mail and/or phone. Winner will be required to complete and execute an affidavit of eligibility/compliance/ liability release, and, where lawful, publicity release, to be returned within 3 days of the date documents are delivered. Travel companion must also execute and return a travel liability release. If the travel companion is a minor, parent or legal guardian must sign and return release and accompany minor on the trip. In the event of noncompliance with the Official Rules, if a winner cannot be reached at the address/phone number on winner’s entry within 48 hours of the first attempt, or if the prize or prize notification is returned as unclaimed or undeliverable, an alternate winner will be selected.
Instant Win Game Winners will be allowed one Game prize per person per day. Each Game winner will be contacted by email and/or phone and asked to provide their mailing address in order to receive their prize. Odds of winning will depend on the total number of Instant Win Game entries received and the timing of the entry during the Game Promotional Period. If a Game winner does not respond within fourteen (14) days after notification, their prize will be forfeited. Prizes cannot be substituted, except as provided herein. Sponsor reserves the right to substitute Prize with one of equal or greater value should feature Prize become unavailable. Prizes are not transferable and may not be exchanged for other prizes or for cash. All federal, state and local taxes are sole responsibility of Winner.
Prize Conditions: Sweepstakes Grand prize winner and travel companion are responsible for complying with all conditions for international travel as may be required by law and airlines, including but not limited to having valid photo ID, a valid U.S. passport, a visa and any other documents that may be required. All winners of the Promotion are solely responsible for all applicable federal, state, and local taxes and/or any other fees/costs associated with the receipt of any prize. All taxes, if applicable, are the sole responsibility of the winner. The winner’s entry and acceptance of the prize offered constitutes permission (except where prohibited by law or Sponsor’s Privacy Policy) for the Sponsor to use said winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation.
Internet Limitations of Liability: If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes in whole or in part, at any time, without notice and award the Grand Prizes using all non-suspect eligible entries received as of, or after (if applicable) this cancellation, termination, modification or suspension date, or in any manner that is fair and equitable. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Use of Data: Sponsor will be collecting personal data about entrants including mobile phone numbers and e-mail addresses in accordance with its Privacy Policy. By participating in the Promotion and providing this information, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy.
Terms & Conditions: This Promotion is subject to all applicable federal, state, and local laws. By entering the Promotion, entrants agree to release, discharge, indemnify and hold harmless the Released Parties , and each of their respective directors, officers, employees, shareholders and agents from any and all liability, loss, damage or injuries to any person (including death) or property of any kind sustained in connection with their participation in the Promotion or from their acceptance, receipt, possession and/or use or misuse of the prize, or for any typographical or other error in the printing, offering or announcement of the prize. Entrants further acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, relative to the prize, including, but not limited to, its quality or fitness for a particular purpose. Any person attempting to defraud or in any way tamper with the Promotion mechanics and/or implementation will be prosecuted to the fullest extent of the law. By participating, entrants agree to be bound by these Official Rules and the decisions of the Promotion Administrator, and waive any right to claim ambiguity in the Promotion or these Official Rules. Sponsor reserves the right to disqualify any entrant that Sponsor determines, in its sole discretion, violates these Official Rules. This Sweepstakes is void where prohibited.
